Im heute begonnenen "Motion Hearing" gegen den mutmaßlichen WikiLeaks-Informanten Bradley Manning wurde auch der Vorwurf der "Unterstützung des Feindes" durch die zuständige Richterin näher erklärt. Die Anschuldigung: Manning soll durch seine Weitergabe zahlreicher Geheimdokumente an die Whistleblowing-Plattform WikiLeaks indirekt das Terror-Netzwerk al-Qaida unterstützt haben.

In der Anhörung (gulli:News berichtete) verlas die zuständige Militärrichterin, Colonel Denise Lind, die Antworten auf eine Reihe von an die Anklage gerichteten Fragen bezüglich der gegen Manning erhobenen Vorwürfe. Dabei wurde auch der Vorwurf der "Unterstützung des Feindes" - ein Verstoß gegen den umstrittenen "Espionage Act" und der Hauptanklagepunkt gegen Manning - näher spezifiziert. Manning, so der Vorwurf, soll durch die Weitergabe der Informationen an WikiLeaks indirekt al-Qaida-Terroristen auf der arabischen Halbinsel unterstützt haben. Wie genau dieser Vorwurf zustande kommt, ist den öffentlichen Berichten über die Anhörung bislang nicht zu entnehmen.

Kommentar: Die Beschuldigungen eines politischen Schauprozesses in der ehemaligen UDSSR können auch kaum absurder gewesen sein...

Die Staatsanwaltschaft hat unerwartete Probleme beim Anklagen von Bradley Manning. Und zwar haben sie diverse belastende Materialien nie bekommen. Weil (festhalten!):

At a hearing last month, prosecutors in the case against Pfc. Bradley Manning noted that they didn't receive the messages but could not explain why. Chief prosecutor Capt. Ashden Fein said at a hearing Thursday that the messages had been "blocked by a spam filter for security." However, it fell to defense attorney David Coombs to explain precisely why the e-mails about evidence issues in the Manning case never made it.
"Apparently, they were blocked because the word 'WikiLeaks' was somewhere in the e-mail," Coombs said.

Kann man sich gar nicht ausdenken, sowas.

Seit Anfang der Woche veröffentlicht Wikileaks von der US-Sicherheitsfirma Stratfor interne E-Mails, die Hacker Ende des Jahres 2011 erbeutet haben. Stratfor unterhält der Enthüllungsplattform zufolge nicht nur enge Beziehungen zu Rüstungsfirmen, sondern berät auch den US-Geheimdienst sowie US-Strafverfolgungsbehörden. Darunter sind demnach das Heimatschutzministerium, die US Marines und der Verteidigungsnachrichtendienst der Vereinigten Staaten.

Der schriftliche Meinungsaustausch von Stratfor-Mitarbeitern legt nahe: Manch ein Kunde hat Interesse daran, das Julian Assange und die Enthüllungsplattform von der Bildfläche verschwinden.

Den E-Mails zufolge fürchteten die Mitarbeiter bereits Ende des Jahres 2010, dass Assanges Haft ihn in den Augen der Öffentlichkeit zum Märtyrer machen könnte. Als Strategie schlug der Absender "burton@stratfor.com" - also vermutlich Vizechef Fred Burton - seinen Analysten vor: "Seine Verbündeten aufzuspüren, ist auch ein Schlüssel. Findet die unzufriedenen Verbrecher. Schickt ihn von Staat zu Staat, konfrontiert ihn für die nächsten 25 Jahre mit verschiedenen Vorwürfen. Aber holt euch alles, was er und seine Familie besitzen."

Als Anklagepunkte gegen Assange empfiehlt er "Verschwörung" und "Politischer Terrorismus". Um dies zu begründen, regte er an, "den Tod einer Quelle zu enthüllen", die in Verbindung mit Wikileaks gesetzt werden könne.

"Versiegelte Anklageschrift"

Möglich ist, dass diese Strategie schon beschlossene Sache ist. Eine Klage der USA gegen Assange liegt einer anderen Mitteilung zufolge spätestens seit Anfang 2011 in der Schublade. "Wir verfügen über eine versiegelte Anklageschrift gegen Assange", heißt es dort.

Absender der vertraulichen E-Mail an einen ranghohen Mitarbeiter von Stratfor: abermals burton@stratfor.com. Der lästert zusätzlich: "Im Gefängnis wird Assange eine gute Braut sein. F*** den Terroristen. Er wird für immer Katzenfutter fressen." Insgesamt will Wikileaks mehr als fünf Millionen vertrauliche E-Mails von Stratfor besitzen.

Das Unternehmen hatte den Diebstahl "einer großen Anzahl E-Mails" am Montag zugegeben. Es bezichtigte Wikileaks in einer Stellungnahme, dass manche Veröffentlichungen "womöglich gefälscht", andere aber "womöglich authentisch" seien.

Zweifelhafte Methoden

Stratfor steht für "Strategic Forecasting", "Strategische Vorhersagen". Dem Unternehmen wird auf Basis der der erbeuteten Korrespondenzen unter anderem vorgeworfen, dass es Mitarbeiter dazu anhalte, zweifelhafte Methoden für die Informationsbeschaffung zu verwenden. Dazu gehört etwa auch, dass sie betreffende Personen zum Sex verführen, um sie auszuhorchen.

Hintergrund der Auseinandersetzung ist, dass Wikileaks und Julian Assange auch durch die Veröffentlichung vertraulicher US-Diplomatendepeschen den Zorn Washingtons auf sich gezogen haben.

Wer hätte gedacht, dass Wikileaks doch noch ein bisschen Dampf hat. Oder vielleicht ist das auch nur PR, wer weiß das schon. Jedenfalls hat Wikileaks Enthüllungen "gegen die schwedische Regierung" angekündigt. Also es geht natürlich nicht gegen die Regierung an sich, sondern gegen die ganzen Amerika-Arschkriecher in der Regierung, und die erste angekündigte Enthüllung geht um den Außenminister, Carl Bildt. Der soll seit 1973 als US-Informant tätig sein, und sein Kontaktmann sei ausgerechnet Karl Rove, "Bush's Brain".

When it comes to abuses, the government is using severe punishment of high-profile whistleblowers as a method of encouraging silence, TomDispatch writes:

On January 23rd, the Obama administration charged former CIA officer John Kiriakou under the Espionage Act for disclosing classified information to journalists about the waterboarding of al-Qaeda suspects. His is just the latest prosecution in an unprecedented assault on government whistleblowers and leakers of every sort.

The Obama administration has already charged more people—six—under the Espionage Act for alleged mishandling of classified information than all past presidencies combined. (Prior to Obama, there were only three such cases in American history.)

By now, there can be little doubt that government retaliation against whistleblowers is not an isolated event, nor even an agency-by-agency practice. The number of cases in play suggests an organized strategy to deprive Americans of knowledge of the more disreputable things that their government does. How it plays out in court and elsewhere will significantly affect our democracy.

Kiriakou, in particular, is accused of giving information about the CIA’s torture programs to reporters two years ago. Like the other five whistleblowers, he has been charged under the draconian World War I-era Espionage Act.

That Act has a sordid history, having once been used against the government’s political opponents. Targets included labor leaders and radicals like Eugene V. Debs, Bill Haywood, Philip Randolph, Victor Berger, John Reed, Max Eastman, and Emma Goldman. Debs, a union leader and socialist candidate for the presidency, was, in fact, sentenced to 10 years in jail for a speech attacking the Espionage Act itself. The Nixon administration infamously (and unsuccessfully) invoked the Act to bar the New York Times from continuing to publish the classified Pentagon Papers.
